Biography

Jennifer Aguilar is a senior associate in the Payments and Fintech Group at Alston & Bird. She counsels a variety of financial services clients, including banks, credit unions, third party service providers, and FinTech companies, on regulatory and transactional matters, with a focus on payments laws and network rules. Jennifer frequently advises clients on issues relating to compliance with the Nacha Operating Rules, Regulation E, Regulation CC, and the Uniform Commercial Code. Jennifer also has broad experience helping clients navigate payments fraud claims, including various claims under the Uniform Commercial Code and consumer claims under Regulations E and Z. Before joining Alston & Bird, Jennifer was an associate at a law firm in a leading consumer financial services group, where she advised clients on requirements relating to prepaid cards, credit cards, checks, ACH, deposit products, and installment lending. She also served as counsel at the National Association of Federally-Insured Credit Unions (NAFCU), where she provided comprehensive compliance assistance on the federal consumer financial services regulations to the nation’s credit unions.

How is the nominee propelling the industry forward?

Jennifer is a leading advisor to financial institutions and other payments industry participants on payments regulation and compliance. In addition to client work through the law firm, Jennifer is a frequent speaker and lecturer at payments industry conferences and educational events, including all of those offered by Nacha as well as events sponsored by regional ACH associations. Clients and the industry as a whole look to Jennifer for her ability to distill the most complex regulations and network rules into practical and actionable advice. She is indubitably an industry leader in payments regulation and compliance!

Where do you see the nominee succeeding in the future?

Jennifer will succeed by continuing to build on the incredible foundation she already has established in the payments industry. Her reputation will continue to expand as will demand for her legal advice, her leadership at conferences and her contributions to education. I have no doubt that, ten years from now, Jennifer will be one of a small handful of preeminent payments regulatory attorneys in the country. I know of no other person in our industry under 40 who is better qualified than Jennifer for this distinction.
